Pay-to-Play Agreement for XBOX Console This Pay-to-Play Agreement (the “Agreement”) is made between the Guest (referred to as “you” or “the Guest”) and Alexa Smart Home (referred to as “we” or “the Organizer”). This Agreement sets forth the terms and conditions under which the Guest agrees to pay for and use a XBOX Console (referred to as “the Console”) provided by Alexa Smart Home for gaming purposes. Payment: The Guest agrees to pay the specified fee for the use of the Console. The payment must be made in advance, prior to the commencement of the gaming session. Accepted forms of payment include cash, credit card, or any other mutually agreed-upon method. Use of the Console: The Guest agrees to use the Console solely for gaming purposes. The Guest shall abide by the rules and guidelines set forth by Alexa Smart Home, including any restrictions on game selection, duration of play, and appropriate behavior. Care and Responsibility: The Guest agrees to exercise reasonable care in handling and using the Console. The Guest shall not tamper with, modify, or attempt to repair the Console. Any damage caused to the Console due to negligence or misuse shall be the responsibility of the Guest, and the Guest may be liable for the cost of repair or replacement. Game Selection: Alexa Smart Home will provide a selection of games for the Guest to choose from. The Guest agrees to select games in accordance with Alexa Smart Home’s guidelines and restrictions. The Guest shall not attempt to install or play unauthorized or pirated games on the Console. Time Allocation: The Guest agrees to adhere to the agreed-upon time allocation for the gaming session. Alexa Smart Home reserves the right to limit the duration of play to ensure fairness and accommodate other guests. Additional gaming time may be purchased, subject to availability and Alexa Smart Home’s discretion. Conduct and Behavior: The Guest agrees to conduct themselves in a respectful and appropriate manner while using the Console. The Guest shall not engage in any form of harassment, cheating, or disruptive behavior. Failure to comply with these standards may result in immediate termination of the gaming session without refund. Limitation of Liability: Alexa Smart Home shall not be held liable for any damages, loss, or injury arising from the use of the Console during the gaming session. The Guest acknowledges that Alexa Smart Home is not responsible for any software or game-related issues, including compatibility, performance, or content. Termination: Alexa Smart Home reserves the right to terminate the gaming session at any time due to technical issues, misconduct, or any other circumstances that may jeopardize the integrity of the gaming experience. In the event of termination, the Guest may be entitled to a partial refund at Alexa Smart Home’s discretion. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Alexa Smart Home operates. Entire Agreement: This Agreement constitutes the entire agreement between the Guest and Alexa Smart Home regarding the use of the Console and supersedes any prior agreements or understandings, whether written or oral. By signing below, the Guest acknowledges that they have read, understood, and agree to the terms and conditions of this Pay-to-Play Agreement for the XBOX Console.
